Welcome to DPlans ("we," "our," or "us"). By accessing or purchasing from our website at dplans.com, you agree to these Terms of Service ("Terms"). Please read them carefully before using our website or purchasing any products.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS WEBSITE OR PURCHASE ANY PRODUCTS.


1. General Terms

These Terms govern your use of the DPlans website and all digital products purchased from it.

By purchasing from us, you confirm that you:

  • Are at least 18 years old
  • Have read, understood, and agreed to these Terms
  • Have the legal capacity to enter into a binding contract

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes constitutes acceptance of the modified Terms.


2. About Our Products

2.1 What We Sell

All products sold are digital architectural and structural engineering plans for timber-frame construction projects including houses, garages, sheds, pergolas, and similar structures.

2.2 Product Packages

  • Standard Plan: PDF files containing complete construction drawings, structural calculations, cutting bills, material pick lists, 3D visualizations, foundation and framing details, and QR code access to interactive 3D web viewer. Includes both metric (millimeters) and imperial (inches) versions.
  • Pro Plan: Everything in Standard Plan plus DWG files, IFC files, and access to MiTek Pamir viewer software for enhanced viewing capabilities.

2.3 Digital Delivery Only

No physical goods are shipped. After payment confirmation, you will receive an email with download links to access your digital files.


3. Origin and Design Standards

3.1 Design Origin

All plans are originally designed for the European Union market using European standards (EN 1990, EN 1995, EN 1991) and subsequently converted to include imperial measurements for international use.

3.2 Structural Design Software

Plans are created using MiTek Pamir, a licensed professional structural engineering software, ensuring high-quality calculations and specifications.

3.3 Timber Specifications

Plans specify C24 strength class timber according to EN 338. For the U.S. market, the recommended equivalent is MSR 1650f-1.5E SPF lumber. However:

  • The final choice of lumber grade must always be verified by a licensed structural engineer in your jurisdiction
  • Local building codes, environmental conditions (snow load, wind load, seismic activity, humidity), and material availability must be considered
  • Alternative lumber grades may only be used if confirmed and approved by a responsible professional engineer in compliance with applicable standards (ANSI/TPI 1, AS/NZS, or regional equivalents)

4. License and Intellectual Property Rights

4.1 Limited License

All plans are licensed, not sold. You are granted a limited, non-exclusive, non-transferable license to use the purchased plan for one construction project only, for a single individual or household.

4.2 No Ownership Rights

You do not acquire any ownership rights, intellectual property rights, or any other legal rights to the plans themselves. All rights, title, and interest in the plans remain exclusively with DPlans.

4.3 Strictly Prohibited Uses

You may NOT:

  • Copy, duplicate, or reproduce the plans for any purpose other than your single licensed project
  • Sell, resell, distribute, or share the plans with any third party
  • Upload, publish, or post the plans to any website, platform, or public forum
  • Use the plans for multiple projects or commercial purposes
  • Modify the plans and distribute them
  • Remove or alter any copyright notices, watermarks, or proprietary markings

Violation of these restrictions may result in legal action and claims for damages, including attorney fees.

4.4 Permitted Modifications

You may modify the plans as necessary to comply with local building codes and site-specific requirements, provided such modifications are performed by or under the supervision of a licensed professional.


5. Payment and Pricing

  • All purchases must be paid in full at checkout
  • Payments are processed securely through third-party providers (PayPal, credit/debit cards, Apple Pay, Google Pay)
  • Prices are displayed in USD and may change without notice
  • All prices are final at the time of purchase

6. Delivery

  • Download links will be sent to your email address within minutes of payment confirmation
  • Delivery is worldwide and free of charge
  • You are responsible for providing a valid, active email address
  • Download links are typically valid for 30 days from purchase date
  • If you experience technical issues downloading files, contact us immediately at info@dplans.com

7. Refunds and Cancellations

7.1 All Sales Are Final

Due to the digital nature of our products, all sales are final once you receive your download link.

7.2 Exceptions

Refunds may only be issued if:

  • We fail to deliver the purchased files within 48 hours of payment
  • The files are corrupted and cannot be opened (we will first attempt to resend working files)

7.3 No Refunds For

  • Change of mind after download
  • Plans not meeting local building codes (see Section 8)
  • Discovery that modifications are required
  • Difficulty understanding technical drawings
  • Project abandonment or change of plans

8. CRITICAL: Legal Compliance and Professional Review

8.1 Your Legal Responsibility

YOU ARE FULLY RESPONSIBLE for verifying that the use of any plan complies with all applicable laws, zoning regulations, building codes, and permit requirements in your jurisdiction.

Local requirements vary significantly by:

  • Country, state, province, county, and municipality
  • Seismic zones and earthquake standards
  • Wind load requirements
  • Snow load requirements
  • Soil type and foundation requirements
  • Climate and humidity conditions
  • Fire safety codes
  • Accessibility requirements

8.2 Professional Review Required

THESE PLANS MUST BE REVIEWED BY LICENSED PROFESSIONALS before construction begins, including but not limited to:

  • Structural Engineer: To verify structural adequacy for your specific site conditions, local loads, and material availability
  • Architect or Building Designer: To ensure compliance with local codes
  • General Contractor or Builder: To verify constructability and site-specific requirements
  • Soil Engineer (if applicable): To determine appropriate foundation design

8.3 No Guarantee of Approval

DPlans does not guarantee that these plans will be approved by your local building authority without modifications. Plans may require adjustments for:

  • Local building code compliance
  • Site-specific conditions
  • Material substitutions
  • Engineering stamps or seals required in your jurisdiction

8.4 Permits

You are responsible for obtaining all necessary building permits, inspections, and approvals before beginning construction.


9. Material Specifications and Quantities

9.1 Material Quantities

Material quantities included in the plans are calculated based on the specific project design. Actual quantities may vary depending on:

  • Site conditions
  • Construction methods
  • Cutting waste and errors
  • Material dimensions from your supplier
  • Local adjustments

It is strongly recommended to purchase additional materials (typically 5-15% extra) as a reserve to cover waste, cutting losses, or unforeseen circumstances.

9.2 Material Quality

You are fully responsible for:

  • Verifying all material quantities
  • Ensuring sufficient materials are ordered
  • Confirming that only high-quality, certified construction materials are used
  • Ensuring lumber meets or exceeds the specified strength class (C24 or regional equivalent)
  • Verifying connector plates, fasteners, and hardware meet specified standards

9.3 Material Availability

Plans specify materials and hardware that may not be available in all regions. You are responsible for sourcing appropriate equivalents and verifying their suitability with a structural engineer.


10. User Responsibilities and Site Verification

10.1 On-Site Verification

All dimensions, specifications, and material requirements shown in the plans must be checked and verified on-site by you or your chosen builder before construction begins.

10.2 Site-Specific Conditions

You must assess and account for:

  • Soil bearing capacity and type
  • Groundwater level and drainage
  • Slope and grading
  • Existing utilities and easements
  • Property boundaries and setback requirements
  • Access for construction equipment
  • Local climate and weather patterns
  • Proximity to trees, structures, or natural features

10.3 Safety Requirements

You are required to follow all applicable safety practices, use proper tools and equipment, and ensure construction is carried out in accordance with occupational health and safety regulations.


11. WARRANTY DISCLAIMER

11.1 NO WARRANTIES

THESE PLANS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness
  • Suitability for your specific site or conditions

11.2 No Professional Relationship

Purchase of these plans does not create any professional relationship (architect-client, engineer-client, or contractor-client) between you and DPlans. We are not providing engineering or architectural services.

11.3 Information Only

Plans are provided for informational purposes only and must be reviewed, modified as necessary, and approved by licensed professionals in your jurisdiction before use.


12. LIMITATION OF LIABILITY

12.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DPLANS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Your use or inability to use the plans
  • Construction activities based on the plans
  • Property damage of any kind
  • Personal injury or death
  • Loss of profits, revenue, or business
  • Cost of substitute materials or services
  • Delays, defects, or errors in construction
  • Structural failures or building code violations
  • Rejection of plans by building authorities
  • Any other losses or damages of any kind

12.2 Liability Cap

In no event shall our total liability to you exceed the amount you paid for the plans.

12.3 Assumption of Risk

BY USING THESE PLANS, YOU EXPRESSLY ASSUME ALL RISK AND RESPONSIBILITY for the construction process and any consequences that may arise from it.


13. Indemnification

You agree to indemnify, defend, and hold harmless DPlans, its owners, affiliates, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:

  • Your use of the plans
  • Your construction activities
  • Violation of these Terms
  • Violation of applicable laws, regulations, or building codes
  • Injury or damage to any person or property
  • Any negligence or misconduct in construction

14. Technical Support and Modifications

14.1 What We Provide

We provide technical support limited to:

  • Assistance with downloading files
  • Clarification of plan contents
  • Information about the design specifications

14.2 What We Do NOT Provide

We do not provide:

  • Custom modifications to plans
  • Site-specific engineering advice
  • Building code interpretation for your jurisdiction
  • Construction guidance or supervision
  • Engineering stamps or professional seals
  • Responses to building inspector questions or concerns

14.3 Custom Plans

We do not currently offer custom plan design services or modifications to existing plans.


15. Connector Plates and Hardware

Plans specify MiTek connector plates as the recommended solution. These are perforated galvanized steel plates designed to meet international standards (EN 14545, ANSI/TPI 1, AS/NZS 1649).

You may use equivalent connector plates from other manufacturers, provided they are:

  • Perforated and galvanized
  • Fully compliant with relevant regional standards
  • Verified for compatibility with the design by a structural engineer

Using non-standard or incorrect plates is entirely your responsibility and must be verified for compliance before construction.


16. Foundation and Structural Requirements

Plans include foundation layouts showing perimeter and timber structure. Plans do not include:

  • Detailed electrical wiring layouts
  • Detailed plumbing layouts
  • HVAC system design
  • Interior finishes
  • Landscaping or grading plans

You are responsible for engaging appropriate professionals (electricians, plumbers, HVAC contractors) for these systems and for ensuring all work complies with local codes.


17. Privacy

Your use of our website is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and process your personal information.


18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.

18.2 Jurisdiction

Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the competent courts of Vilnius, Lithuania.

18.3 EU Consumer Rights

If you are a consumer residing in the European Union, you may also have rights under EU consumer protection regulations that cannot be waived by this agreement.

18.4 Waiver of Class Actions

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.


19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.


20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DPlans regarding your use of our services and supersede all prior agreements and understandings.
